1.2. The personal data of the Service User (Customer) is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter “GDPR”), and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
1.3. The Administrator ensures the utmost care to protect the interests of data subjects, particularly by ensuring that the collected data is processed lawfully, collected for designated, lawful purposes, and not subjected to further processing inconsistent with these purposes. The data is factually correct, adequate in relation to the purposes for which it is processed, and stored in a form that allows for the identification of individuals for no longer than necessary to achieve the processing purposes.
1.4. All words, expressions, and acronyms used in this document and starting with a capital letter (e.g., Seller, Online Store, Electronic Service) should be understood according to their definitions in the Online Store Regulations available at: immortalnutrition.eu/store-regulations.
2.1. The Administrator collects personal data for the following purposes:
2.1.1. Establishing, shaping the content of, amending, executing, or terminating a contractual relationship between the Service Provider (Seller) and the Service User (Customer) involving the provision of Electronic Services via the Online Store or concluding and executing a Sales Agreement for Products and delivering them to the Customer.
2.1.2. Direct marketing of the Administrator’s own products or services.
2.2. The Administrator processes the following personal data of Service Users (Customers): name and surname; email address; contact phone number; address (street, house number, apartment number, postal code, city, country); delivery address and address for the sales document, if different from the above. In the case of Customers who are also business entities, the Administrator also processes the company name and NIP number.
2.3. Providing the personal data specified in point 2.2. is necessary for the Service Provider to provide Electronic Services via the Online Store or to conclude a Sales Agreement. The required scope of data is specified before the provision of a specific Electronic Service or the conclusion of a Sales Agreement.
2.4. The Administrator automatically collects data stored in Cookies during the use of the Online Store website. These are text files stored on the Customer’s computer while using the Online Store, enabling, among other things, the saving of cart contents. The Cookie mechanism is not used to obtain any information about Online Store Users.
2.5. The provision of personal data by the Customer is voluntary; however, it is necessary for the purposes specified in section 2.1 of this Privacy Policy, including the conclusion and performance of the Sales Agreement. Failure to provide the data may prevent the order from being fulfilled.
2.6. Customers’ personal data may be processed in an automated manner (including profiling); however, this will not produce any legal effects concerning the Customer or similarly significantly affect them. Profiling may involve analyzing or predicting purchasing preferences in order to tailor offers, marketing content, or advertisements.
3.1. If the Customer selects a shipping method via postal or courier service in the Online Store, the Administrator shares the collected personal data of the Customer, to the extent necessary for delivery, with the selected carrier executing the shipment on behalf of the Administrator.
3.2. If the Customer chooses electronic payment or payment by card in the Online Store, the Administrator shares the collected personal data of the Customer, to the extent necessary for payment processing, with the selected payment provider handling the above payments in the Online Store.
4.1. The Customer has the right to access their data and the right to rectify, delete, limit processing, transfer data, object, and withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
4.2. To exercise these rights, requests can be sent to the email address: shop@immortalnutrition.eu or in writing to the Administrator’s address.
4.3. The Customer has the right to lodge a complaint with a supervisory authority – in Poland, this is the President of the Personal Data Protection Office (PUODO) – if they believe that the processing of their personal data violates the provisions of the GDPR.
5.1. The Administrator applies technical and organizational measures ensuring the protection of processed personal data appropriate to the risks and category of data under protection, particularly securing the data against unauthorized access, acquisition by an unauthorized person, processing in violation of applicable regulations, and alteration, loss, damage, or destruction.
5.2. Personal data is transmitted via a secure SSL protocol, ensuring data encryption.
5.3. Access to the Customer’s Account is only possible after providing an individual login and password. The Customer is obliged to keep their password confidential and not share it with third parties.
6.1. The Online Store may contain links to other websites. The Administrator is not responsible for the privacy policies applicable to those sites. The Administrator encourages Users to review the privacy policies established on those sites upon visiting them. This Privacy Policy applies only to the Online Store IMMORTALNUTRITION.EU.
6.2. The Administrator reserves the right to amend this Privacy Policy. Changes will be published on this page. Customers will be informed of any significant changes via appropriate notices on the Online Store’s website or through email communication.
